Patents 3G: Apple and Samsung intrigue the European commission

The European Commission investigation into the practices of Samsung and Apple's use of "essential patents" in the market for mobile telephony.

Brussels focuses on intellectual property covering the 3G-UMTS (mobile internet).

The question is whether the two firms comply with the European regulatory framework in the management of their respective intellectual properties in the "wireless" (tablets and smartphones).

The patent war that oppose disorder Samsung and Apple's competitive environment, under the influence of the two groups in the business of mobility.

It lists twenty procedures in ten countries in the world.

And the European Union is also concerned. Apple and Samsung are in open conflict in countries such as Germany, the Netherlands and France.

As it stands, this is just a formal request from the European Commission, to which both companies are invited to respond.

The approach is clear TheInquirer: based on evidence gathered in Brussels wants to determine whether the use of patents are still in a FRAND ("Fair, Reasonable and Non Discriminatory)" or whether there is to mount an antitrust case.

According to a document sent to the end of October a California court by the manufacturer of the iPhone and the iPad is that Samsung would be left primarily in the focus of European institutions.
